Shuttered Venue Operators Grant

The Shuttered Venue Operators (SVO) Grant program was established by The Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act, signed into law on December 27, 2020. The program includes over $16 billion in grants to shuttered venues, to be administered by SBA’s Office of Disaster Assistance.

Who can Apply

Targeted toward the Operators of:

  • Theatrical producers and talent representatives
  • Live performing arts organizations
  • Museums
  • Independent motion picture theatres
  • Zoo(s)
  • Aquariums that meet certain criteria and more

Other requirements of note:

  • Must have been in operation as of February 29, 2020
  • Venue or promoter who received a PPP loan on or after December 27, 2020, will have the SVOG reduced by the PPP loan amount
Criteria

Must meet the following criteria:

  • Must have been in operation as of February 19, 2020, to be eligible
  • Can’t receive an SVOG if the venue received a PPP Loan after December 27, 2020
  • Can have an Economic Injury Disaster Loan (EIDL) or plan to apply for one and receive the grant
  • Can have a First Draw PPP loan prior to December 27, 2021, and receive the grant
Priority Levels

The U.S. Small Business Administration (SBA) updated the proposed plan for issuing grants during the first and second priority periods. To clarify, priority awardees will not need to satisfy the small employer set-aside. During the first 59 days of opening SVOG, SBA will reserve no less than $2 billion of program funding for grants to entities that have no more than 50 employees.

  • First Priority Grant: In the initial 14 days of the program, grants will be exclusively made to those with 90% or greater revenue loss between April 2020 through December 2020
  • Second Priority Grant: In the second 14 days, grants will be to those with 70% or greater revenue loss between April 2020 through December 2020
  • Third Priority Grant: Entities that suffered a 25% or greater revenue loss between April 2020 through December 2020 (28 days after First & Second Priority Awards are made)
  • Supplemental Funding: Recipients of first, second, and third priority round awards who suffered a 70% or greater revenue loss for the most recent calendar quarter (as of April 1, 2021, or later).
Required Documentation

Organizational Documents

  • Written Certification of Need –
  • Government issued photo ID of the business owner or authorized representative of the entity
  • Business license, if applicable (required by city, county, or state laws)
  • The name, EIN, and DUNS number for each of the applicant’s affiliates, if applicable

Financial Documents

  • 2019 Tax Return
  • 2020 Tax Return
  • 2018 Tax Return (only required for non-profit organizations which have not ended their 2020 fiscal year)
  • Bankruptcy Documents (only required if Chapter 11 or Chapter 13 bankruptcy)
  • Tax-exempt status documentation (in the form of 501(a) exempt status, government charter), if applicable

Standard Forms

Applicant-Specific Documents

  • Live Venue Operator or Promoter, Theatrical Producer, or Live Performing Arts Organization Operator: Floor Plan (or comparable documentation) demonstrating defined performance and audience areas and plan of grounds if outdoor space is used for the performance venue
  • Motion Picture or Theatre Operator: Floor Plan of the facility that identifies the projection booth or space containing a motion-picture projector
  • Museum Operator:
    • Floor Plan (or comparable documentation) demonstrating indoor exhibit spaces and at least one auditorium, theater, or performance or lecture hall with fixed seating
    • A document with links to State or local ordinances documenting pandemic-related occupancy restrictions (orders from government officials or offices)
    • Documentation of non-profit or not-for-profit status (in the form of tax-exempt status letter – only required for non-profit entities)
Registration

SVOG applicants must register with the federal government’s SAM at www.SAM.gov to apply and cannot use an ITIN, EIN, or other means of identification or registration. Interested parties are encouraged to obtain a Dun and Bradstreet (DUNS) number (a prerequisite for SAM registration) as soon as possible. With a DUNS number, interested parties then should immediately begin registering in SAM.gov, as the SAM registration may take up to two weeks once submitted.

Allowable Use of Funds
  • Payroll costs
  • Rent payments
  • Utility payments
  • Scheduled mortgage payments (not including prepayment of principal)
  • Scheduled debt payments (not including prepayment of principal) on any indebtedness incurred in the ordinary course of business prior to 02-15-20)
  • Worker protection expenditures
  • Payments to independent contractors (not to exceed $100K in annual compensation per contractor)
  • Other ordinary and necessary business expenses, including maintenance costs
  • Administrative costs (incl. fees and licensing)
  • State and local taxes and fees
  • Operating leases in effect as of 02-15-20
  • Insurance payments
  • Advertising, production transportation, and capital expenditures related to producing a theatrical or live performing arts production. (May not be the primary use of funds.)

Grantees may not use award funds to:

  • Buy real estate
  • Make payments on loans originated after February 15, 2020
  • Make investments or loans
  • Make contributions or other payments to, or on behalf of, political parties, political committees, or candidates for election
  • Pay for any other use prohibited by the Administrator

Grantee recordkeeping

Grantees will be required to maintain documentation demonstrating their compliance with the eligibility and other requirements of the SVOG program. They must retain employment records for four years following their receipt of a grant and retain all other records for three years.
